What if I wasn’t wearing my helmet during the accident?

California Vehicle Code Section 27803 specifies that you and your passenger have to wear a safety helmet while riding a motorcycle. That doesn’t mean you can’t claim damages for injuries sustained in a motorcycle accident caused by the negligence of another.

It may be difficult to prove facial or head injuries when you were not wearing a helmet. Other injuries, such as injuries to your lower body, should not be dismissed due to the failure on your part to wear a safety helmet.

Can I sue the city of Los Angeles for a road defect?

Motorcycles are more vulnerable to road defects than cars. The City of Los Angeles is expected by road users to properly maintain its roads. If a pothole, loose gravel, or any other road defect causes you to wreck your motorcycle, you may have a case against the City of Los Angeles.

Can I sue the motorcycle manufacturer for damages?

Does it matter if I was riding on the dotted line between two lanes?

Many motorcycles drive between lanes when cars are not moving or are moving very slowly. This is called “lane splitting” and it’s legal in the State of California. There are a couple of exceptions though. Lane splitting isn’t allowed at high speeds or under unsafe conditions.
